Terms and Conditions

1. Definitions

• 1.1 “Company”, “we”, “us”, “our” means Blue Brick Concrete & Aggregates Ltd.
• 1.2 “Customer” means the person, firm or company purchasing Goods or Services.
• 1.3 “Goods” means ready-mixed concrete, aggregates, topsoil and any other materials supplied by the Company.
• 1.4 “Services” means delivery and any associated services provided by the Company.

2. Basis of Contract

• 2.1 All quotations are given subject to these Terms & Conditions.
• 2.2 A binding contract is formed only when the Company accepts the Customer’s order.
• 2.3 These Terms apply to the exclusion of any other terms the Customer seeks to impose.

3. Prices

• 3.1 All prices are quoted in Pounds Sterling (£).
• 3.2 Prices are exclusive of VAT, which will be charged at the prevailing UK rate.
• 3.3 Prices are subject to change without notice prior to order confirmation.

4. Delivery & Load Sizes

• 4.1 A full load of ready-mixed concrete is 6m³.
• 4.2 Load size may be reduced to 5.4m³ where high workability mixes are requested.
• 4.3 The Customer must provide safe and suitable access for delivery vehicles.
• 4.4 The Company shall not be liable for damage caused where site access is unsuitable.

5. Waiting Time Charges

• 5.1 An allowable time of 30 minutes on site is included from the time of arrival.
• 5.2 Waiting time beyond 30 minutes will be charged at £90.00 per hour.
• 5.3 Waiting time will be charged at the rate above and calculated in hourly increments.

6. Part Load Charges

• 6.1 A full load is 6m³ (subject to clause 4.2).
• 6.2 Loads below full capacity will incur a part load charge of £20.00 per m³.
• 6.3 Part loads will be charged at the rate stated above.

7. Returned Concrete & Disposal

• 7.1 Returned concrete will incur a charge of £50.00 per m³.
• 7.2 There is a disposal charge for any concrete returned.
• 7.3 Returned concrete charges apply regardless of reason unless agreed otherwise in writing by the Company.

8. Cancellations

• 8.1 Orders cancelled after acceptance may be subject to charges.
• 8.2 For pours exceeding 50 cubic metres, a cancellation fee of £15.00 per cubic metre will be applied if the order is cancelled after 15:00 on the day prior to delivery.

9. Specification & Standards

• 9.1 Concrete for aggressive ground conditions will be supplied in accordance with Special Digest 1:2005 (Concrete in Aggressive Ground Conditions).
• 9.2 The Customer is responsible for confirming the required specification at the time of order.
• 9.3 The Company accepts no liability where incorrect specification is requested by the Customer.

10. Payment Terms

• 10.1 Payment terms are strictly as agreed at account setup or point of order.
• 10.2 The Company reserves the right to charge interest on overdue accounts in accordance with the Late Payment of Commercial Debts (Interest) Act 1998.
• 10.3 The Company may suspend further deliveries where payment terms are not adhered to.

11. Risk & Title

• 11.1 Risk passes to the Customer upon delivery.
• 11.2 Ownership of Goods remains with the Company until full payment is received.

12. Inspection & Claims

• 12.1 The Customer must inspect Goods at the point of delivery.
• 12.2 Any shortages or defects must be noted on the delivery ticket and reported within 48 hours.
• 12.3 Concrete cannot be returned once discharged.

13. Limitation of Liability

• 13.1 Nothing in these Terms limits liability for death or personal injury caused by negligence.
• 13.2 The Company shall not be liable for indirect, consequential, or economic loss.
• 13.3 Liability is limited to the value of the Goods supplied.

14. Force Majeure

The Company shall not be liable for delay or failure due to circumstances beyond its reasonable control including adverse weather, traffic delays, breakdowns, raw material shortages or industrial action.

1. General Policy

Due to the perishable nature of ready-mixed concrete and bulk aggregates, returns are strictly limited.

2. Concrete

• 2.1 Concrete cannot be returned once discharged.
• 2.2 Any concrete returned in the vehicle will incur £50.00 per m³ returned concrete charge.
• 2.3 A disposal charge applies to all returned concrete.

3. Aggregates & Other Materials

• 3.1 Returns will only be accepted with prior written agreement.
• 3.2 Goods must be unused and uncontaminated.
• 3.3 The Customer is responsible for return transport costs unless the return is due to Company error.

4. Incorrect Supply

If the Company supplies incorrect Goods, it will at its discretion:

• Replace the Goods, or
• Issue a credit note/refund for the affected quantity.

5. Refunds

Approved refunds will be processed within 28 days. Delivery charges are non-refundable unless due to Company error.
